TEXT MESSAGING TERMS AND CONDITIONS

Conduent State & Local Solutions, Inc. (hereafter,"We," "Us," "Our") is offering a mobile messaging service (the "Service") in support of your receipt of Electronic Benefits Transfer (EBT) benefits from your EBT program, By opting in and participating in this Service, you accept and agree to these "Text Messaging Terms and Conditions" and the accompanying "Privacy Policy" (together, the "Agreement"). This Agreement is limited to the Service, and is not intended to modify any other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts.

1. Participation Requirements: By participating in the Service, you acknowledge and agree that you are eighteen (18) years of age or older. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

2. Providing Telephone Numbers and Duty to Notify: You verify that the mobile number you provided to the EBT Program or to Us directly is true and accurate. You verify that you are the current subscriber or owner of any telephone number that you provide. Should any of your contact information change, including ownership of your telephone number(s), you agree to immediately notify your agency of the change or call the number at the back of the card.

3. Your Consent to Receive Automated Calls/Texts: You agree that by voluntarily providing your telephone number(s), you are expressly agreeing to receive recurring automated text messages (such as SMS, MMS, or successor protocols or technologies) from Us concerning the Service, the EBT Program, your benefit account, and/or the transactions you perform thereunder.

4. Text Message Frequency. The message frequency under the Service will vary, in accordance with relevant developments related to your participation in and continued eligibility for the EBT Program.

5. Cost. We will not charge you any fee for automated text messages under the Service. However, We encourage you to check with your mobile service provider to see what other message and data rates may apply, including any applicable roaming charges. We are not responsible for any fees or charges from any carrier or service provider for Service communications.

6. Access or Delivery to Mobile Network is Not Guaranteed. Delivery of information and content to your mobile device is not guaranteed and may fail due to a variety of circumstances or conditions. Alerts sent via text message may not be delivered if the mobile phone is not in range of a transmission site, sufficient network capacity is not available at a particular time, or the wireless carrier from which you receive service is not supported. Even within a supported wireless carrier's coverage area, factors beyond the control of the carrier may interfere with message delivery, including the customer's equipment, terrain, proximity to buildings, foliage, and weather. We will not be held responsible for any delays in the receipt of any text messages as delivery is subject to effective transmission from your mobile service provider or network operator. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Our control.

7. Opt-Out Instructions: Your consent to receive automated texts is completely voluntary. You may opt out at any time. To opt out of text messages, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us. You may also text HELP for help. You acknowledge and accept that you will be sent a final text message confirming your opt-out.

8. Termination of Service. We may suspend or terminate your use of the Service if We conclude that you are in breach of these Terms and Conditions. Your receipt of Service communications is also subject to termination in the event your telephone or network service terminates or lapses. We reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Service with or without notice.

9. Miscellaneous: You warrant and represent to Us that you have all necessary rights, power, and authority to agree to these Terms and to perform your obligations hereunder. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. We reserve the right to change this Agreement from time to time. Any updates to this Agreement shall be communicated to you. You acknowledge your responsibility to review this Agreement from time to time and to be aware of any such changes. By continuing to participate in the Service after any such changes, you accept this Agreement, as modified.

10. DISCLAIMER OF WARRANTIES: OUR TEXT MESSAGING SERVICES ARE OPERATED ON AN "AS-IS," "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONDUENT AND ITS PARENT, SUBSIDIARIES, AFFILIATES AND AGENTS MAKE NO REPRESENTATION ABOUT THE SUITABILITY OR AVAILABILITY OF OUR TEXT MESSAGING SERVICES FOR ANY PURPOSE, AND ALL SUCH SERVICES ARE PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
